Content Use and Ownership
All content on MindPerk.com is copyrighted and you are not permitted to copy images, text, or other content from MindPerk.com to be published or broadcast in any form, whether print or electronic, in any media or website. You may browse, print, and use the information for your own personal use only. All MindPerk generated content is owned by MindPerk, Inc.
Guest Content Submissions
We welcome content submissions to MindPerk.com and invite qualified contributors to register and submit articles, reviews, videos, comments or other relevant content. In order to comply with recent Google restrictions and guidelines, guest authors must comply with the following:
- Guest authors must write a short bio (commercial) for themselves, including a true picture of the author. The bio should mention the author’s accomplishments and may reference his or her website, but will not include a clickable link to the website.
- Contributed articles must contain only original, unique content. They may not contain quotes, stories, or other content that is the work of someone else or that appear elsewhere on the web.
- Contributed articles must be exclusively written for MindPerk and may not be posted on any other website, including the author’s own website. This eliminates the possibility of duplicate content (which can hurt both MindPerk and the Author’s site). Having unique content on MindPerk helps the author by boosting his or her exposure and introducing our thousands of readers to the author.
These guidelines protect both the author and MindPerk from negative penalties from Google and are designed to give the author the best possible chance of improved exposure through guest posting on MindPerk. All contributing authors retain full copyright of their submitted content, but grant a release for MindPerk to use, modify, and publish all submitted content. While we make every reasonable effort to maintain the integrity of your submission, for our protection, MindPerk reserves the right to edit, modify, or reject any submitted content, including articles, images, descriptions, links, biographies, blogs, comments, ratings, etc. Submissions can be rejected or edited for style, including spelling, grammar, punctuation errors, etc. Submissions can be rejected or edited for content, including content which contains sexually explicit references; profanity; vulgarity; links; descriptions or promotion of violence; discrimination based on race, sex, nationality, disability or age; promotes illegal activity; violates intellectual property rights; is incomplete or incoherent; or which is in any way deemed inappropriate by the editors at MindPerk.com, at their sole discretion. Submissions may be edited or rejected without the permission or notification of the contributor or author.
Relationship of Parties
You and MindPerk are independent parties, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, representation, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf, nor do you have permission to represent yourself as an authorized representative of MindPerk, Inc. You will not make any statement, whether on your website or otherwise, that reasonably would contradict this statement.
Trademarks, Logos, and Copyright
The trade name “MindPerk” and variations thereof, including “Mind Perk” “MindPerks” “MindPerk.com” etc., plus the MindPerk trademarks, logos, and banners are the property of MindPerk, Inc. You may use the name MindPerk only in connection with links directed to a location within MindPerk.com. Registered affiliates may also use the MindPerk banners and/or trade name only on their own website in connection with affiliate links to MindPerk.com, and only while their affiliate account is active with us. (See the Affiliate Agreement for more details.) You may not use our trade name “MindPerk” or “Mind Perk” or any other word or phrase combination which may be interpreted as use of our trade name in advertising of any kind, including pay-per-click advertising. All content on MindPerk.com is copyrighted and you are not permitted to copy images, text, video clips, articles, or any other content from MindPerk.com without express written permission. All products purchased from MindPerk, including downloadable content, are copyrighted materials. As such, they are for your personal use only. Customers
Customers who purchase products and services through MindPerk.com will be deemed to be customers of MindPerk, Inc. Accordingly, all MindPerk rules, policies, and operating procedures concerning customer orders and service will apply to those customers. MindPerk reserves the right to reject any order that does not comply with our rules, operating procedures and policies. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time.
Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement, even if we have been advised of the possibility of such damages. While we make every effort to verify the accuracy of our information and content, including product listings, descriptions, images, prices, etc., we will not be liable for errors or misrepresentations which may be present.
Disclaimers
We make no express or implied warranties or representations with respect to the use of information contained on MindPerk.com. In addition, we make no representation that the operation of our site or sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. The laws of the United States and the District of Columbia will govern this Agreement, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in The State of Utah, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. By browsing, viewing, or using content, submitting content, exchanging links, participating in our affiliate program, or purchasing products on MindPerk.com, you acknowledge that you have read this agreement and agree to all its terms and conditions.
